END-USER LICENSE AGREEMENT (EULA) &
TERMS OF USE FOR “Theory 7-12”

IMPORTANT – READ CAREFULLY

This End-User License Agreement (“EULA”) is a legal agreement between you (an individual or entity) and the private individual operating “Theory 7-12”. It governs your access and use of the Theory 7-12 software, web application, mobile application, related documentation, and any updates provided (“Product”). By accessing, installing, copying, or using the Product, you agree to be bound by the terms of this EULA. If you do not agree, do not use the Product.

1. LICENSE GRANT

You are granted a non-exclusive, non-transferable, non-sublicensable, worldwide license to access and use the Product for personal or internal use only. All rights not expressly granted are reserved by the owner. You may not:

  • Share access credentials (usernames or passwords) with third parties;
  • Use the Product for any unlawful purpose or in a way that infringes third-party rights;
  • Sell, rent, lease, sublicense, distribute, or commercially exploit the Product;
  • Reverse-engineer, decompile, or disassemble any part of the Product.

2. USER-GENERATED CONTENT

If you transmit or upload any content (“Content”) via the Product, you represent and warrant that you have all necessary rights to do so. You agree not to submit any Content that:

  • Infringes copyright or intellectual property rights of any party;
  • Violates privacy rights of individuals;
  • Contains viruses, malicious code, or harmful components;
  • Is illegal, threatening, or defamatory.
You agree not to bypass security mechanisms or attempt unauthorized access to restricted areas of the Website or server infrastructure.

3. COPYRIGHT & OWNERSHIP

All materials — including but not limited to text, diagrams, images, code, animations, audio, and design — are the intellectual property of the creator of Theory 7-12, unless otherwise indicated. The Product is protected by international copyright treaties and laws. You may not reproduce, modify, or use any part of the Product without explicit written permission.

4. DISCLAIMER OF WARRANTIES

The Product is provided “as is” without warranties of any kind. The creator disclaims all express or implied warranties, including but not limited to warranties of merchantability, fitness for a particular purpose, and non-infringement. No guarantee is made that the Product will be uninterrupted, error-free, or meet your expectations or technical configurations.

5. LIMITATION OF LIABILITY

To the fullest extent permitted by applicable law, the creator of Theory 7-12 shall not be liable for any indirect, incidental, special, consequential, or punitive damages — including loss of data, profits, or business interruption — arising out of the use or inability to use the Product.

6. CUSTOMER REMEDIES

If you are dissatisfied with the Product, your sole and exclusive remedy is to discontinue use. Any liability shall not exceed the amount paid (if any) for access to the Product.

7. GOVERNING LAW

This Agreement is governed by and shall be construed in accordance with the laws of Ukraine, without regard to its conflict of law principles. You agree to submit to the exclusive jurisdiction of the courts of Ukraine for the resolution of any disputes.
